Louisiana moved into Phase One of reopening on May 15, 2020.[1]  Landlords and tenants continue to be significantly impacted by the COVID-19 pandemic. The ramifications that the pandemic may have on specific leases is fact and contract specific.

Many commercial and residential tenants are requesting lease modifications from their landlords.  Sample COVID-19 Lease Modification Application (commercial) and COVID-19 Lease Modification Application (residential) are provided.  These sample forms are not mandatory forms.  The forms provide suggested requests for information and documentation from the tenant for the landlord’s use in evaluating the tenant’s lease modification request.  If a lease modification is agreed upon by the landlord and tenant, the modification should be in writing.  See also Necessary Documentation and Privacy Considerations.

For a discussion of potential legal issues pertaining to leases during the pandemic, see Louisiana REALTORS®’ article, Landlord/Tenant, Eviction, and Foreclosure Issues.  Each lease should be carefully examined and considering these novel circumstances, you should consult with an attorney in analyzing the landlord’s or tenant’s rights under the lease.
