2026 Legislative Session: What Louisiana REALTORS® Are Focusing On

The 2026 Legislative Session starts Monday, March 9th, and for REALTORS® across Louisiana, this is the time when policy decisions will directly impact property rights, housing affordability and consumer protection.

 

As the session begins, Louisiana REALTORS® is entering focused, prepared, and proactive. The housing market is stabilizing, mortgage rates are easing and financing capacity has improved. However, supply constraints remain. That means state-level policy matters now more than ever.

 

Our job is simple, protect property rights, defend consumers and strengthen the real estate marketplace.

 

Consumer Protection: Bringing Clarity to Wholesaling Practices

One major focus this session is consumer protection. Louisiana REALTORS® is advancing a bill that addresses unregulated wholesaling practices.

 

Unregulated wholesaling has created confusion and risk in the marketplace. In some cases, consumers believe they’re entering into traditional transactions when they’re not. The proposed legislation aims to bring clarity and transparency, ensuring that individuals engaged in real estate transactions for compensation operate within proper regulatory guidelines.

 

This is about protecting consumers. It’s about protecting sellers, particularly vulnerable homeowners, from misleading practices. And it’s about preserving integrity in our marketplace.

 

Property Management: Extending Security Deposit Timelines

Another priority is property management reform. Louisiana REALTORS® is supporting a bill to extend the security deposit return window from 30 days to 60 days.

 

The current 30-day timeline does not reflect today’s operational realities, especially in larger or disaster-impacted markets. Extending the return period allows property owners and managers to properly assess damages, obtain contractor estimates, and ensure accurate reconciliation.

 

This balances fairness to tenants with practical realities for housing providers. It’s modernization, not rollback.

 

Property Rights and Housing Supply

Beyond individual bills, broader policy themes will also shape the session. Private property rights remain foundational. Louisiana REALTORS® will oppose regulatory overreach that devalues ownership.

 

At the same time, policies that increase housing supply through streamlined development and reduced permitting friction are critical.

 

If we want affordability, we must address supply. That’s the structural issue.

 

Legislative Climate: Engagement is Key

The political environment this year shows strong interest in economic growth and reform, aligning closely with REALTORS® priorities. But alignment requires active engagement. Louisiana REALTORS® will be present, constructive, and firm where necessary.

Louisiana’s 2026 Regular Session opened this week with several developments that matter directly to REALTORS ®, property managers and housing providers, alongside some broader political shifts worth watching. HB 292: Security Deposit Return Timelines Rep. Delisha Boyd’s HB 292, which addresses procedures for returning residential security deposits, was heard in committee but deferred to next week. This provides additional time for stakeholders to engage with members on practical impacts for lease administration, move out inspections and documentation standards. We’ll continue working to ensure any changes to deposit law are clear, workable and do not expose housing providers to unreasonable liability. Land Use and Development: St. James Parish Decision The Louisiana Supreme Court’s recent St. James Parish decision significantly tightens the standards for overturning local land use decisions, reinforcing that zoning and permitting authority rests with parish and municipal governments as long as their decisions are not arbitrary or capricious. For real estate and development, that means more predictability if projects are aligned with adopted plans and ordinances, but also higher stakes in local elections, planning processes and parish-level negotiations. Governor’s State of the State In his State of the State address, Governor Jeff Landry reiterated his push to phase out the state income tax, expand the LA GATOR and MJ Foster scholarship and workforce programs, and replace vehicle inspection stickers with a QR code system. While some of these proposals are controversial, they frame a debate around long-term competitiveness, workforce readiness and household cost of living which are all key drivers of housing demand and migration patterns. Business & Market Trends The business community is focusing the session on insurance, workforce and energy. Commercial and property insurance costs remain a top concern for employers and property owners, and we are monitoring civil justice and insurance reform proposals that could affect market stability and availability. At the same time, Louisiana is seeing more than $100 billion in announced industrial and data center projects, which could reshape local markets, labor conditions and housing needs in multiple regions of the state.
